General Terms and Conditions

 

1. object of the contract, contractual partner

 

1.1 These General Terms and Conditions govern the sale of access authorizations or tickets for tours or events of the “Project Jewish Heritage Austria” of Co-Victory GmbH based in Vienna, Austria (hereinafter also “we” or “JHA ” or “co-victory”) to our customers (hereinafter also “you”) via our website www.jewishheritage.at and our email addresses office@jewishheritage.at or other emails ending with @jewishheritage.at as well as office@ljewishwalks.at and office@co-victory.com (and the service has a connection with the mediation of Jewish Austrian history).

1.2 If individual provisions of these GTC are invalid or void or become invalid or void in the course of their validity, the effectiveness and validity of the remaining provisions shall remain unaffected.

 

2. order and conclusion of contract (ticket booking)

 

2.1 All offers of the Jewish Heritage Austria project of Co-Victory GmbH are subject exclusively to these General Terms and Conditions. Amendments, supplements or ancillary agreements to these General Terms and Conditions, offers and services as well as the waiver of the written form requirement can only be made in writing. All ticket and event offers are non-binding and are only valid while stocks last.

2.2 To book tickets for the guided tours or events offered via the booking system, the customer clicks on the link on our website, which redirects them to the booking system. In the booking system, the customer is guided through the booking steps and selection options (e.g. number of tickets, date). By clicking on the “Check-Out/Order/Reserve or order with obligation to pay” button, the customer submits a binding offer to conclude a purchase contract with us.

Acceptance is effected by sending the ticket or the booking confirmation by e-mail and by making the ticket available on the website as a PDF file after successful booking. This concludes the purchase contract between us and the customer. If a tour is unfortunately already fully booked, we will inform the customer by e-mail and refund the amount already paid to the original payment method.

2.3 If the customer does not order tickets via the booking system, but by e-mail via office@jewishheritage.at or one of our associated e-mail addresses, the customer submits a binding offer to conclude a purchase contract with us with his order. Acceptance takes place by sending the ticket by e-mail or confirmation to the customer, whereby the purchase contract between us and the customer is concluded.

2.4 In the case of offers of discounts, the required information must be provided correctly. There is no entitlement to a discount. The customer must present an official photo ID when entering or starting a guided tour in order to prove their entitlement to the discount and to verify their identity.

2.5 The customer agrees that the Jewish Heritage Austria project may send invoices, payment requests and reminders to Co-Victory GmbH by e-mail.

2.7 Tickets are issued exclusively for the persons named on them and must correspond to the date of birth stated. They are non-transferable and may only be used by the person whose name and date of birth match the details on the ticket. Rebooking or transferring tickets to another person is not permitted under any circumstances. The accuracy of personal details is crucial to ensure smooth admission. Any discrepancies may result in admission to the event or tour being refused.

 

3. prices and terms of payment

 

3.1 The prices displayed in the booking system and by e-mail are in euros and are gross prices.

3.2 Payment is made online using the payment methods offered and completes the online booking process.

3.3 In the case of purchases made by e-mail, payment must be made within 14 days of the invoice being sent to the bank account specified by Co-Victory GmbH or by an alternative method of payment agreed with the customer, but promptly upon receipt.

3.4 If the customer defaults on payment, the Jewish Heritage Austria project of Co-Victory GmbH shall charge statutory default interest from the due date. Reminder fees will be charged if the customer is sent a reminder. The amount of the reminder fees is based on the Ordinance on the High Rates of Remuneration Due to Collection Agencies (www.ris.bka.at). If it is necessary to involve a debt collection agency, lawyer or court, the customer shall bear the full costs of the intervention.

3.5 In the case of credit card chargebacks where the bank decides that Co-Victory GmbH’s Jewish Heritage Austria project successfully resolves the case in its favor, the customer is obliged to pay a fee of €100 plus statutory VAT to Co-Victory GmbH. This fee covers the additional personnel and organizational costs arising from the attempted chargeback.

 

4. no right of withdrawal (right of revocation)

 

4.1 The Jewish Heritage Austria project of Co-Victory GmbH offers tickets to cultural events (guided tours) or general events for a specific date and time online or via electronic means of communication (e-mail, telephone and short message services). This is a leisure event with a specified time period. Therefore, there is no right of withdrawal pursuant to Section 18 (1) no. 10 of the Distance and Off-Premises Selling Act.

 

5. validity of the ticket and delay of the customer

 

5.1 The ticket or booking confirmation is only valid for the date and time for which it was issued. Late redemption is not possible.

5.2 If the customer arrives late, Projekt Jewish Heritage Austria of Co-Victory GmbH reserves the right to shorten the event by the duration of the delay without changing the ticket price. If the customer does not show up after 15 minutes, Projekt Jewish Heritage Austria der Co-Victory GmbH reserves the right to cancel the tour. In this case, the ticket price will not be refunded.

5.2 The ticket must be presented in printed or digital form before the start of the tour. If the customer is unable to present the ticket, they are not entitled to participate. The customer is responsible for carrying the ticket legibly. Illegible tickets will not be accepted.

5.3 The customer undertakes not to print out the ticket more than once or to duplicate and misuse it in any other way.

5.4 If a customer has made unauthorized use of a discount when booking a ticket and cannot provide proof of the conditions for the discount, the ticket is invalid. The price will not be refunded. The customer has the option of paying the difference to the correct ticket price on site in order to maintain the validity of the ticket.

 

6. cancellation of a guided tour or event

 

6.1 We reserve the right to cancel appointments for guided tours or events. In the event of cancellation by us, the customer will be refunded the price and the ticket for the canceled date will become invalid. Cancellation will be made by e-mail.

6.2 Refunds will be made via the payment method selected by the customer at the time of booking.

 

7. security check

 

7.1 Participants may be subject to a security check before the start of the tour and admission. This is particularly the case when entering Jewish sights, event venues or government buildings. Among other things, the customer must provide proof of identity (e.g. ID) on site. The Jewish Heritage Austria project of Co-Victory GmbH is not liable for forgotten proof of identity and loss of time in connection with missing ID cards – if the customer misses an event or tour due to a lack of proof of identity, the missed time will neither be refunded nor supplemented at the end of the event.

7.2 If the customer does not behave in accordance with the safety measures on site, the customer will be excluded from the event. The price will not be refunded.

 

8 Warranty and liability

 

8.1 The warranty shall be governed by the statutory provisions.

8.2 The customer is responsible for providing an error-free and functioning e-mail address. The Jewish Heritage Austria project of Co-Victory GmbH shall not be liable if damage occurs due to an incorrectly provided e-mail address.

8.3 The Jewish Heritage Austria project of Co-Victory GmbH shall not be liable if the service offered cannot be provided in accordance with the contract due to force majeure or unforeseen and unavoidable events.

 

9. affiliate marketing (partner)

 

The Jewish Heritage Austria project of Co-Victory GmbH cooperates with other service partners within the framework of affiliate marketing. Through this cooperation, our website offers the products and services of these partners in return for an agreed commission. In the event of a contract being concluded, the General Terms and Conditions (GTC) of the respective partner apply. The GTC govern the contractual relationships and conditions between the customer and the specific service partner. It is the customer’s responsibility to check and accept the GTC of the respective partner before concluding the contract. Projekt Jewish Heritage Austria of Co-Victory GmbH assumes no liability for the services of the partners and recommends that customers familiarize themselves with the relevant GTC.

 

10. final provisions

 

10.1 Every contract concluded with us is subject to Austrian law to the exclusion of the conflict of law rules of private international law.

10.2 The contract language is German or English. The German version shall be authoritative.

 

11 If a customer is an entrepreneur, the following also applies:

 

11.1 The Jewish Heritage Austria project of Co-Victory GmbH shall be liable for damages caused intentionally or through gross negligence by the Jewish Heritage Austria project of Co-Victory GmbH or its vicarious agents. Liability for damages caused by negligence is excluded. This does not apply to liability for personal injury.

11.2 The prices quoted are gross prices. The statutory default interest for B2B transactions shall apply.

11.3 Any contract concluded with us shall be governed exclusively by Austrian law to the exclusion of the UN Convention on Contracts for the International Sale of Goods and the conflict of laws rules of private international law.

11.4 The place of jurisdiction for entrepreneurs is Vienna.
